[Whitehall, Ohio] August 21, 2018 – On Friday, August 17, 2018, Franklin County Environmental Court Judge Dan Hawkins issued an order approving the sale of the Woodcliff Condominium property to the City of Whitehall. The City and Franklin County Public Health first filed the public nuisance action against the property in 2007, seeking to have the nuisance conditions abated.
Since the original filing, the development has been declared a public nuisance twice, and has had three different judges and four court appointed receivers attempt to work with the interested parties to abate the nuisance conditions at the development. Judge Hawkins’ order confirms that the nuisance conditions still persist unabated 11 years later. “We agree with the Judge that there was no other viable way to permanently abate this public nuisance,” said Whitehall Mayor Kim Maggard.
Friday’s order follows a May 14, 2018 meeting of the units’ owners, where it was voted 172-77 to recommend accepting the City’s offer to purchase the development. The August 17th order will allow the City to move forward and work with the current court appointed receiver on transfer of the property, who the City anticipates will be sending out a notice of purchase to Woodcliff residents and owners as of this week.
“Franklin County Public Health is pleased that this case has been settled. The nuisance conditions at the property have continued to be unsafe and risked the health and safety of those who lived in and around the complex” said Joe Mazzola, Franklin County Health Commissioner.
The City is working to initiate workshops for tenants and owner-occupants to be scheduled upon Whitehall taking ownership of the property, to address questions relating to property management at Woodcliff for the term of qualifying leases and twelve months for owner-occupants. The City is committed to abating the nuisance conditions that have persisted, including the demolition of the structures after expiration of existing leases.
